1. Seller and contact details

The owner of the maqster website, the seller of goods and digital content and the provider of the services described in these terms and conditions is I4S spółka z ograniczoną odpowiedzialnością, a limited liability company with its registered office in Lublin, Poland, hereinafter the Seller.

Notices, complaints and correspondence may be sent to the postal or email address given above. The address for returns and complaint-related shipments must be confirmed before sales begin. Agreeing on a shipping method must not be made a condition for valid withdrawal from a contract or for making a complaint.

2. Scope and buyer's rights

These terms and conditions cover use of the website and account, purchases of devices, modules, mechanical components and 3D prints, delivery of digital files, including STL designs and MP3 recordings, and subscriptions to the maqster app. The product or plan offer specifies its features, requirements and the scope of the service. Hardware, separately purchased files and subscriptions are separate items unless the offer expressly provides for a bundle.

A consumer is a natural person entering into a legal transaction that is not directly related to their business or professional activity. Rights relating to withdrawal from a contract and the conformity of goods, digital content and digital services with the contract also apply to a natural person entering into a contract directly related to their business activity where that contract is not of a professional nature for that person, as determined in particular by the business activities recorded in Poland's Central Register and Information on Business Activity (CEIDG). We refer to such a person below as an Entrepreneur with Consumer Rights.

If the professional nature of the contract is not apparent from its content, such a person may submit a statement on this matter no later than when the contract is concluded. Conclusion of the contract is not conditional on submitting that statement. Purchasing against an invoice or selecting the Business plan does not, by itself, exclude statutory protection.

These terms and conditions are provided free of charge before the contract is concluded. They can be saved and printed from the browser. The version provided when a particular contract is concluded applies to that contract. No provision of these terms or the licence excludes rights that the buyer cannot waive.

3. Account and electronic services

The website provides access free of charge to the offer, contact forms, the cart, the customer account and the forum. Using the website requires an internet connection and a browser supporting HTML5, JavaScript and essential session cookies. A working email address is required to create an account, make purchases and correspond with us. Requirements for the app and products, including the operating system, compatible hardware and internet access needed for particular functions, are specified in their descriptions before purchase.

The account service agreement is concluded after registration and confirmation of the email address in accordance with the activation message. It is concluded for an indefinite period. The account provides access, among other things, to orders, purchased files and licences. Purchasing paid files requires an account to which access will be assigned. Creating an account does not itself constitute purchasing a subscription.

The user must provide truthful information, protect their password and report suspected unauthorised access. It is prohibited to submit unlawful content, impersonate others, send spam or disrupt the website. The user may stop using a form or the cart before submitting it. Sending an enquiry about a product, presentation or Business plan does not conclude a paid contract.

The user may terminate the account agreement free of charge by emailing the Seller. The Seller confirms termination. A request to close an account with an active subscription also constitutes cancellation of its next renewal. Closing the account does not remove claims arising from contracts already concluded or rights to separately purchased files; continued access to those files must be agreed before the account is closed. Retention of legally required records is described in the privacy policy.

The Seller may restrict use of an account to the extent necessary to stop confirmed breaches of law, security threats or serious violations of these rules. The Seller informs the user of the reason, scope and duration of the restriction and how it may be challenged, unless disclosure is prohibited by law. Where possible, the Seller first requests that the breach cease. Measures must be proportionate and must not deprive the user of statutory claims or rights to services already paid for.

4. Orders and prices

The buyer selects a product or plan, supplies the required details, selects the available delivery and payment methods and checks the summary. Until the order is confirmed, the buyer may correct details and change the selected items. Before purchase, the buyer receives information about the main features of the service, the total price, additional costs and the fulfilment date and, for subscriptions, the billing period and renewal rules.

Prices for consumers are gross prices and include applicable taxes. The currency is shown next to the price. Delivery costs and the costs of other selected services are stated before the order is placed; paid extras require express consent. Where a price reduction is announced, the lowest price in the 30 days before the reduction is stated, or, if the product has been offered for a shorter time, the lowest price since it was first offered.

The order is placed using the Order and pay button or another button that unambiguously indicates an obligation to pay. It constitutes an offer to enter into a contract on the terms shown in the summary. The contract is concluded when the Seller's email confirming acceptance of the order for fulfilment reaches the buyer. A technical acknowledgement of receipt of the order does not conclude a contract unless it also accepts the order.

The Seller emails confirmation of the contract together with its terms, the applicable version of the terms and conditions, withdrawal instructions and form, and any consents or requests submitted regarding early commencement of performance. The documents are provided in the email or as an attachment that can be retained. A link to a page that may change does not replace that copy.

The ordered product may not be unilaterally replaced, the price increased or the agreed date postponed. If fulfilment is affected by a problem, the Seller informs the buyer and agrees a solution while respecting the buyer's statutory rights. Amounts collected for an order that has not been accepted are refunded without undue delay.

5. Payments and delivery

Payment and delivery methods available for a particular order, supported countries, costs and the payment deadline are shown before the order is confirmed. Online payments for goods and digital files are handled by Przelewy24. The buyer selects from the methods made available for that order in the payment operator's form. App subscriptions are billed through Stripe in accordance with section 6. The Seller remains the party to the contract for the goods, digital content or service ordered and is responsible for its performance. Use of a payment operator does not limit complaints submitted to the Seller.

Goods are delivered to the address or collection point selected in the order. The delivery period, including preparation and delivery, is stated before purchase; unless another date has been agreed, goods must be delivered without undue delay and no later than 30 days after the contract is concluded. Pre-orders and products made to order require a delivery date to be clearly stated before purchase. They do not justify an indefinite wait.

The Seller is responsible for loss of or damage to goods until they are received by the consumer or a person designated by the consumer other than the carrier. An exception applies where the consumer independently selects a carrier not offered by the Seller. A damage report may help clarify the matter, but is not a condition for accepting a complaint.

Digital files are made available in the account after payment is confirmed, within the period agreed before purchase or, if no separate period was agreed, without undue delay. The method of subscription activation and the start of the paid period are specified in the order. Lack of access or downloading an incorrect file should be reported to the Seller. Rights in the event of non-delivery are described in section 12.

6. Free, PRO and Business

The Free plan is free of charge and includes the functions listed in its description. The PRO plan costs PLN 19 including tax per monthly billing period or PLN 190 including tax per annual billing period, payable in advance. PLN 190 is the fee for the whole year, not a commitment to twelve separate monthly payments. The user chooses the option.

The scope, price, term and billing arrangements for the Business plan are agreed individually and communicated before the contract is concluded. A request for a quote does not create an obligation to pay. Individual arrangements must not limit the statutory rights of a consumer or an Entrepreneur with Consumer Rights.

A PRO subscription is concluded for an indefinite period and renews for successive monthly or annual periods according to the selected option. Before activation, the user is informed of the amount and frequency of subsequent charges, the first renewal date and how to cancel. Consent to recurring payments is given during the Stripe payment process. Creating an account or using Free does not, by itself, authorise charges to the user.

The user may cancel the next renewal at any time by emailing a statement to the Seller or using the subscription management function provided. Cancellation received before renewal takes effect at the end of the current paid period, at no additional charge. The Seller confirms cancellation and the date on which access ends. A payment collected for a subsequent period despite effective cancellation must be refunded.

The user retains access to PRO functions until the end of the paid period. Rights associated with that plan then expire, while Free functions remain available. Separately purchased goods and licences for STL, MP3 and other files do not expire when the subscription ends unless a fixed-term licence was expressly agreed for the separate purchase. Access to projects and cloud backups after changing plans must be specified in the offer before the contract is concluded. Ending the subscription does not deprive the user of statutory rights to retrieve their own content.

Ordinary cancellation of renewal does not constitute withdrawal from a contract already being performed and generally does not entitle the user to a refund for using only part of the current period. This does not limit the 14-day right of withdrawal, complaints, price reductions, refunds due to non-performance or other statutory rights.

Starting a paid subscription service before the end of the 14-day period requires an express request from the consumer if the Seller intends to charge for services provided up to withdrawal. In that case, the amount due is proportionate to the services actually provided and the agreed price. Without the required request or information, the consumer does not bear those costs. Logging in, activating a plan or using the app does not, by itself, result in the loss of the right to withdraw from an ongoing service. For a paid service, that right may be lost only after the service has been fully performed and the requirements of Article 38(1)(1) of the Polish Consumer Rights Act have been met.

A failed payment does not constitute consent to a new price or service. The Seller informs the user of the failure and allows payment to be completed. Access to paid functions may be suspended after the paid period ends, without affecting rights from earlier purchases. A new price for an ongoing subscription requires the user's prior express acceptance; silence does not constitute consent. The change does not affect a period already paid for.

7. Files, licences and updates

STL, MP3, scenes and other separately purchased files are digital content. Subscription access to the app constitutes a digital service insofar as its service functions are concerned. A device that cannot perform its functions without the software supplied with it is a good with digital elements; in that case, the rules on liability for goods also apply to those elements.

Before purchase, the product description specifies the format, version, size or scope of files, relevant hardware and software requirements, compatibility, interoperability, protection measures and access method. The licence terms specify permitted private or commercial use, any limits on the number of devices or installations, and the period of use. For STL files, the right to produce and sell prints must be specified; for MP3 files, the right to use them in public or commercial installations must be specified. Purchasing a file does not itself transfer economic copyright or third-party rights.

The licence terms provided before purchase and delivered with the contract confirmation apply. Additional restrictions may not be introduced only after payment. Non-excludable rights under copyright law and the buyer's statutory rights to complain and withdraw remain unaffected.

For paid digital content not supplied on a tangible medium, the right of withdrawal is lost only when all statutory conditions have been met: the Seller began performance with the consumer's prior express consent, the consumer was informed beforehand that performance would result in loss of that right and acknowledged this, and the Seller provided the required confirmation on a durable medium. Consent must be separate from acceptance of the terms and conditions. Payment, making a file available or downloading it does not, by itself, replace these conditions.

If the required conditions have not been met, the consumer retains the right of withdrawal and does not bear the costs of the supplied content under Article 36(2) of the Polish Consumer Rights Act. The exception relating to files does not automatically apply to an entire subscription or to goods purchased together with a file.

The Seller provides updates, including security updates, needed to maintain conformity with the contract, and informs the buyer of their availability and the consequences of not installing them. For continuous supply, the obligation lasts throughout the supply period; for a one-off supply, it lasts for the time the buyer can reasonably expect in view of the type of product, its purpose and the circumstances of purchase. Not purchasing a subsequent plan does not, by itself, exclude statutory obligations relating to a separately purchased product.

8. Withdrawal from the contract

A consumer and an Entrepreneur with Consumer Rights may withdraw from a distance contract within 14 days without giving a reason. For the sale of goods, the period starts when the goods are received by the buyer or a person designated by the buyer other than the carrier. For multiple goods delivered separately, in lots or in parts, it starts when the last good, lot or part is received. For regular delivery of goods over a fixed period, it starts when the first good is received. For digital content and services, including subscriptions, it starts when the contract is concluded.

It is sufficient to send an unambiguous statement to the email or postal address in section 1 before the period expires. You may use the form in section 9, but this is not compulsory. The form available with the order in the account is an additional way to submit the statement; having an account is not a condition for withdrawal. The Seller promptly confirms receipt of an electronically submitted statement by email. An order number helps identify the contract but is not mandatory if the contract can be identified in another way.

If the buyer has not received the required information about the right of withdrawal, the period is extended by 12 months from the end of the ordinary period. If that information is received during this time, the buyer has 14 days from receipt to withdraw.

The goods must be sent back or handed over to the Seller without undue delay and no later than 14 days after the withdrawal statement, unless the Seller has offered to collect them. Sending the shipment before the period expires is sufficient. The buyer bears only the direct cost of returning the goods if properly informed of this before purchase and the Seller has not agreed to bear that cost. For a product that cannot normally be returned by post, the return cost must be stated before purchase.

The buyer is liable for diminished value resulting from handling the goods beyond what is necessary to establish their nature, characteristics and functioning, unless the Seller did not properly inform the buyer of the right of withdrawal. Original packaging and a receipt are not conditions for withdrawal. Opening the packaging of a standard device or 3D print does not, by itself, remove that right.

The Seller refunds payments without undue delay and no later than 14 days after receiving the withdrawal statement, including delivery costs up to the amount of the least expensive standard delivery method offered for that order. The refund is made using the same payment method unless the buyer expressly agrees to another method that incurs no cost. For sales of goods, the Seller may withhold the refund until the goods or evidence of their return are received, whichever occurs first, unless the Seller has offered collection. This right to withhold a refund does not apply to a service or file alone.

The right of withdrawal does not apply to non-prefabricated goods produced according to the buyer's specifications or to meet their individual requirements if the conditions of Article 38(1)(3) of the Polish Consumer Rights Act are actually met. This may apply to a 3D print made to an individual design or dimensions. Merely starting production after the order or choosing a standard catalogue option does not establish that exception. The buyer is informed of the specific exception before purchase. This does not restrict complaints.

The exceptions for files and fully performed services are described in sections 7 and 6. A discount, promotion, purchase of a bundle or invoice issued to a sole trader does not, by itself, justify refusing withdrawal. After withdrawing from a digital content or digital service contract, the buyer must stop using it and making it available to others; the Seller may block the access arising from that contract. The Seller remains subject to obligations concerning refunds and access to the user's own content where required by law.

9. Model withdrawal form

10. Making a complaint

Complaints about goods, files, the app or a free electronic service may be sent to the email or postal address in section 1 and, for an order, may also be submitted using the form available in the account. It is helpful to identify the product or service, describe the problem, provide details enabling the contract to be found and the buyer to be contacted, and state the expected solution. A receipt, photographs, original packaging or use of the form are not mandatory conditions for making a complaint.

The Seller responds to a consumer complaint within 14 days of receipt, on paper or another durable medium, in particular by email. Failure to respond within that period constitutes acceptance of the complaint unless a specific provision provides otherwise. The Seller applies the same response rules to an Entrepreneur with Consumer Rights. The response period does not mean that a repair must always be completed within 14 days.

A guarantee, if provided, constitutes an additional right and is honoured under the conditions supplied with the product. It does not replace the Seller's liability for conformity with the contract. The buyer chooses the basis for the complaint; the Seller may not require the buyer to seek the manufacturer's guarantee first.

11. Complaints about goods

For a consumer and an Entrepreneur with Consumer Rights, the Seller is liable for a lack of conformity with the contract that existed when the goods were delivered and becomes apparent within two years of that time, unless the stated useful life is longer. As a rule, a lack of conformity that becomes apparent during those two years is presumed to have existed at delivery. The Seller may not rely on expiry of the period if the lack of conformity was fraudulently concealed.

The buyer may request repair or replacement. The Seller may change the selected remedy if it is impossible or would involve disproportionate costs compared with the other remedy. Both remedies may be refused if both are impossible or would involve disproportionate costs. Repair or replacement must be carried out within a reasonable time and without significant inconvenience. The Seller bears the costs, including collection, transport, materials and labour and, where goods were installed before the lack of conformity became apparent, necessary removal and reinstallation under the statutory rules.

The buyer may request a price reduction or withdraw from the contract for lack of conformity if the Seller has refused to bring the goods into conformity, has not done so properly, the lack of conformity persists after an attempt, or it is apparent from the circumstances that it will not be remedied within a reasonable time or without significant inconvenience. The buyer may exercise these rights immediately if the lack of conformity is sufficiently serious. Withdrawal is not available for an insignificant lack of conformity; the lack of conformity is, however, presumed significant.

The price reduction is proportionate to the difference between the value of conforming and non-conforming goods. The refund due must be made without undue delay and no later than 14 days after receipt of the price reduction statement. When withdrawing for lack of conformity, the buyer returns the goods at the Seller's expense and the Seller refunds the price without undue delay and no later than 14 days after receiving the goods or evidence of their return. The refund uses the same payment method unless the buyer agrees to another method at no additional cost.

For devices with digital elements supplied continuously, the Seller is liable for the conformity of those elements throughout the agreed supply period, and for no less than two years after delivery of the device. The update obligations in section 7 apply accordingly. Incorrect installation resulting from incorrect instructions or carried out by or under the responsibility of the Seller may also constitute a lack of conformity with the contract.

12. Complaints about files and the app

If digital content or a digital service has not been supplied, the consumer or Entrepreneur with Consumer Rights requests the Seller to supply it. If the Seller fails to do so without undue delay or within an additional period expressly agreed, the buyer may withdraw from the contract. No request is needed if the Seller refuses supply, non-supply is apparent from the circumstances, or the agreed date was essential and was not met.

For a file or service supplied once or in parts, liability covers a lack of conformity that existed at supply and becomes apparent within two years. A lack of conformity that becomes apparent in the first year is presumed to have existed at supply. For continuous supply, including subscriptions, the Seller is liable for any lack of conformity arising or becoming apparent throughout the agreed supply period. Losing the right of withdrawal without giving a reason for a properly supplied file does not remove these rights.

The buyer may request that the content or service be brought into conformity with the contract. The Seller must do so free of charge, within a reasonable time and without significant inconvenience. The Seller may refuse if this would be impossible or involve disproportionate costs. The buyer may request a price reduction or withdraw from the contract if bringing the content or service into conformity is impossible or disproportionate, the Seller has failed to remedy the lack of conformity, it persists after an attempt, it is serious enough to justify immediate exercise of those rights, or the circumstances show that it will not be properly remedied within a reasonable time.

For a paid service, withdrawal for lack of conformity is not available where the lack of conformity is insignificant. The Seller bears the burden of proving that it is insignificant. A price reduction is proportionate to the loss in value and, for continuous supply, takes account of the period of non-conformity. The Seller refunds amounts due without undue delay and no later than 14 days after receiving the relevant statement. Settlement of a subscription also includes any advance payment for services that will no longer be supplied following withdrawal. No fee is charged for a period during which the service was not in conformity with the contract.

Following withdrawal, the user may request that content other than personal data which they supplied or created while using the service be made available free of charge, within a reasonable time and in a commonly used machine-readable format. Exceptions concern content useful only in connection with the service, content relating solely to the user's activity in using it, or content combined with other data that cannot be separated without disproportionate effort. Creating content jointly with others does not, by itself, exclude the right to receive it. These rules also apply in other cases provided for by law. Rights relating to personal data arise separately under the GDPR.

13. Forum and moderation

The forum is for discussion relating to maqster and to building and controlling model layouts. An account is required to publish posts. Unlawful content, infringement of others' copyright or privacy, threats, incitement to violence, impersonation and spam are prohibited. A critical opinion about a product or the Seller does not, by itself, breach these terms.

The user retains the rights to their posts and grants non-exclusive, royalty-free permission to store, display and technically copy them as needed to operate the forum. This does not transfer rights to a design or file or permit use of the post in advertising outside the forum.

Illegal content may be reported to the email address in section 1, including without an account. A report should give the exact address of the post, explain why it is illegal, provide the reporter's name or entity name and email address, and include a statement of their good-faith belief that the report is accurate and complete. Exceptions to the requirement to provide details apply in accordance with Article 16(2)(c) of the Digital Services Act. The same address serves as a contact point for users and authorities on DSA matters; contact is available in Polish and English.

The Seller acknowledges receipt of the report, reviews it promptly, diligently and impartially, and informs the reporter of the decision and how it may be challenged. Moderation is carried out by authorised people. Possible measures include leaving content unchanged, requesting a correction, limiting visibility, removing a post, closing a thread and, for serious or repeated violations, proportionately restricting publication.

The author receives reasons for a restriction, including its scope, legal or contractual basis, relevant circumstances and available avenues of appeal, subject to exceptions provided by law. The user or reporter may appeal free of charge by email within six months of receiving notice of the decision. An authorised person reviews the appeal, and a response is provided without undue delay. This does not exclude court proceedings, a complaint to the competent Digital Services Coordinator or other remedies under the DSA.

14. Newsletter and launch notification

The newsletter is a free electronic service provided by I4S sp. z o.o. It includes messages about the launch and development of Maqster, tips, and commercial information and offers relating to Maqster. It requires an email address, access to email and a browser capable of opening the confirmation link.

Subscribing to the newsletter requires entering an address, ticking the consent box and confirming the subscription through the message received. The consent box is not preselected. Confirmation is possible for 48 hours. Without confirmation, the address is not added to the active recipients group. The form is protected against abuse, and resending a confirmation may be temporarily restricted.

Subscribing through the button for the Free version includes the newsletter and notification that the app is available, in accordance with the statement beside the form. At present, only email addresses are collected. Subscribing does not create an account, purchase a Pro subscription or promise a particular launch date. After launch, a message will direct the recipient to their Maqster account. Downloading the app will require registration or login and acceptance of the app's terms of use provided before download.

The newsletter service continues until the recipient unsubscribes or the provider ends it. It may be ended at any time, free of charge, through the unsubscribe link in a message or by contacting the Seller at contact@maqster.com. Unsubscribing does not delete the account or remove rights to an app already received. Newsletter consent is not required to send an enquiry or purchase the Pro plan.

A complaint about the newsletter may be sent to contact@maqster.com, describing the problem and identifying the address used to subscribe. A response will be provided on a durable medium within 14 days of receipt. The privacy policy describes data processing rules and the recipient's rights.

15. Personal data and dispute resolution

The controller of data relating to operation of the website is I4S sp. z o.o. The purposes, legal bases, processing periods, data recipients, cookie rules and users' rights are described in the privacy policy. Accepting the terms and conditions or reading the privacy policy does not constitute consent to a newsletter or other unsolicited marketing messages. Marketing consents are separate and voluntary.

Consumers may seek assistance from a municipal or district consumer ombudsman and use out-of-court dispute resolution, particularly through the competent provincial inspector of the Polish Trade Inspection. Information about bodies, procedures and access to them is available on the UOKiK website on amicable dispute resolution. Participation is voluntary unless an obligation follows from law or a commitment made by the Seller.

If a complaint does not resolve the dispute, the Seller provides the consumer, on paper or another durable medium, with a statement agreeing to participate in an out-of-court procedure and identifying the competent body, or refusing participation, in accordance with the law. Failure to provide the required statement constitutes consent to participate. Using an amicable procedure is not a prerequisite for taking the matter to court.

The contracts are governed by Polish law. This choice does not deprive a consumer of protection afforded by mandatory provisions of the law that would apply in the absence of that choice. Jurisdiction is determined by applicable law; these terms do not impose the court for the Seller's registered office on the consumer. For businesses that do not benefit from consumer protection, liability is governed by the relevant legislation, including the Polish Civil Code, and the agreed contract.

16. Changes to the terms and services

Changes to these terms and conditions do not alter contracts already concluded for the sale of goods or the one-off supply of files. The version provided before an order is placed applies to future orders.

For ongoing account or subscription agreements, changes may result from a change in law directly affecting the service, a final court judgment or binding decision, the need to remove a security threat, or adjustments to technical changes necessary for the service to function. The scope of a change must relate to its cause. This does not authorise arbitrary price changes, removal of paid-for functions or restrictions on the right to complain.

The Seller provides the wording and reasons for a proposed change on a durable medium at least 30 days before it takes effect, and informs the user of the right to terminate the agreement before that date. A shorter notice period may be used only to the extent required by law or necessary to urgently remove a security threat, with notice given without undue delay. If a change requires the user's consent, silence does not replace it.

Changes to digital content or digital services going beyond maintaining conformity with the contract are permitted only to the extent allowed by Articles 43p and 43q of the Polish Consumer Rights Act, for the justified reasons stated above and at no additional cost. This does not apply to digital content supplied on a one-off basis. Where a change significantly and adversely affects access or use, the Seller informs the user reasonably in advance on a durable medium, specifying the date and features of the change and the right to terminate free of charge within 30 days of the change or of receiving notice, whichever is later. This right does not arise if the user is given the option of retaining an unchanged, conforming version at no additional cost.

If a paid service is ended for reasons attributable to the Seller, or the user exercises a statutory right to terminate because of a change, any refund due for the unused period is settled. In all other respects, the applicable legislation applies, in particular the Polish Consumer Rights Act, Civil Code, Act on the Provision of Electronic Services, copyright law and the Digital Services Act.
